These Terms of Use apply only to BurstLume, an offline single-player color-bubble puzzle game for iOS and iPadOS.
1. Acceptance
By downloading, installing, accessing, or using BurstLume, you agree to these Terms of Use.
If you do not agree to these Terms, do not install or use the App.
These Terms supplement any mandatory terms and conditions that apply through the Apple App Store or the user’s device platform.
2. Product description
BurstLume is an offline single-player color-bubble puzzle game for iOS and iPadOS.
Version 1.0.0 may include:
- tap-to-burst color-matching gameplay;
- a rising-row pressure timer;
- gameplay-earned power-ups;
- combo scoring and a local best score;
- local aggregate gameplay statistics;
- an interactive tutorial;
- English and Turkish language options;
- music, sound-effects, and haptic settings;
- Color Assist and Reduced Motion accessibility options;
- an optional rewarded-advertisement Continue feature;
- a policy-limited interstitial advertisement after a completed run; and
- a local Reset Game Data function.
The current version does not include:
- user accounts;
- login;
- passwords;
- cloud save;
- developer-operated backend gameplay storage;
- online multiplayer;
- online leaderboards;
- chat;
- user-generated content;
- in-app purchases; or
- subscriptions.
3. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use BurstLume on compatible devices that you own or control.
This license is provided only for personal, non-commercial entertainment.
No ownership right in BurstLume is transferred to you.
4. Permitted use
You may use BurstLume:
- for personal entertainment;
- on devices you own or control;
- in accordance with these Terms;
- in accordance with applicable law; and
- in accordance with applicable App Store and platform rules.
5. Prohibited conduct
You may not:
- use BurstLume for unlawful purposes;
- redistribute or make unauthorized copies of the App;
- distribute the App outside authorized application stores;
- sell, rent, sublicense, or transfer access to the App;
- remove copyright, trademark, or proprietary notices;
- attempt unauthorized access to application, advertising, platform, or support systems;
- interfere with security, advertising, fraud-prevention, or consent systems;
- exploit defects in a manner that harms the App, another person, or a service provider;
- use automated tools to manipulate rewards, scores, or advertisements; or
- reverse engineer, decompile, or disassemble the App except where applicable mandatory law expressly permits such activity.
6. Offline gameplay
BurstLume is designed so that its core gameplay can operate without an internet connection.
Some optional features, including interstitial advertising, rewarded advertising, legal-page access, support-page access, and privacy-consent services, may require an internet connection.
The unavailability of an internet connection does not guarantee that every optional feature will remain available.
7. Local save data
BurstLume stores gameplay progress and preferences locally on the device.
The App does not provide a BurstLume account or developer-operated cloud-save service in version 1.0.
8. Loss of local progress
Local data may be lost when:
- Reset Game Data is used;
- application data is cleared;
- the App is uninstalled;
- the device is lost or replaced;
- the device is reset;
- the operating system removes data;
- a device backup does not contain the required application data; or
- application data becomes unavailable or corrupted.
We cannot restore deleted local progress from a BurstLume server because no developer-operated cloud-save service exists.
9. No purchases or subscriptions in version 1.0
BurstLume version 1.0 does not include:
- in-app purchases;
- paid virtual currency;
- paid subscriptions; or
- recurring billing.
If paid features are introduced in a future version, the applicable terms, store disclosures, and privacy information will be reviewed and updated before release.
10. Interstitial and optional rewarded advertising
BurstLume may attempt one interstitial advertisement per completed run, only at the natural transition when you tap Play Again or Home, and only when an advertisement is ready.
Interstitial advertisements are not shown during gameplay, during pause, or before the results screen is shown, and are subject to first-run grace periods, minimum time intervals, and maximum-frequency limits that the App applies automatically.
BurstLume may also offer an optional rewarded advertisement for one Continue per run when an advertisement is available.
Watching a rewarded advertisement is optional.
A Continue reward is provided only after the advertising provider reports successful completion of the required rewarded-advertisement event.
Attempting to close, interrupt, manipulate, or bypass an advertisement may prevent a reward from being granted or may otherwise be treated as prohibited conduct under these Terms.
11. Advertisement availability
Advertisement availability is not guaranteed.
An advertisement may be unavailable because of:
- no internet connection;
- consent status;
- regional limitations;
- advertising inventory;
- Google service availability;
- device or platform settings;
- advertising configuration;
- security or fraud-prevention controls;
- local frequency limits already having been reached; or
- the Continue already having been used during the current run.
We do not guarantee that an advertisement will load or that a Continue or interstitial will always be available.
12. Play Again and Home
Watching an advertisement is never required to:
- start BurstLume;
- play the core game;
- use Play Again after a completed run; or
- return to the Main Menu.
Play Again and Home remain available even if an interstitial advertisement is unavailable or fails to show.
13. Third-party services
BurstLume may use third-party services including:
- Apple App Store and platform services;
- Google Mobile Ads;
- Google User Messaging Platform;
- Vercel-hosted legal and support pages; and
- an email service used for support.
Third-party services are governed by their own terms, policies, technical requirements, availability, and regional restrictions.
We do not control third-party advertising inventory, platform availability, or provider outages.
14. Intellectual property
BurstLume, including its:
- name;
- branding;
- software code;
- user interface;
- graphics;
- game design;
- original sound effects and music; and
- other original content
is protected by applicable intellectual-property laws.
You receive no ownership right in the App or its assets beyond the limited license granted in these Terms.
15. Updates
We may release updates that:
- fix defects;
- improve performance;
- change compatibility;
- change graphics or audio;
- adjust game balance;
- add or remove features;
- modify advertising behavior; or
- address legal, privacy, or security requirements.
Some updates may be required to continue using the App on supported devices.
16. Service availability
We do not guarantee uninterrupted availability of:
- advertisements;
- consent services;
- public legal pages;
- support pages;
- email services;
- App Store services; or
- other third-party services.
Core offline gameplay may remain available even when an optional external service is unavailable.
17. Device compatibility
BurstLume requires a compatible device and operating-system version.
Compatibility may change because of:
- Apple platform requirements;
- operating-system updates;
- device limitations;
- dependency requirements; or
- future application updates.
We do not guarantee compatibility with every device or operating-system version.
18. Feature changes
We may change, rebalance, add, suspend, or remove features.
This may include changes to:
- gameplay balance;
- difficulty progression;
- power-ups;
- scoring;
- advertising availability and frequency limits;
- audio;
- accessibility options;
- supported languages; or
- device compatibility.
Features may be changed for technical, security, legal, or balancing reasons.
19. Disclaimer of warranties
To the maximum extent permitted by applicable law, BurstLume is provided “as is” and “as available”.
Except where prohibited by mandatory law, we disclaim implied warranties including merchantability, fitness for a particular purpose, satisfactory quality, and non-infringement.
We do not guarantee that:
- the App will always be uninterrupted;
- the App will always be error-free;
- interstitial or rewarded advertisements will always be available;
- local data will never be lost;
- every device will remain compatible; or
- third-party services will remain available.
20. Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of or inability to use BurstLume.
This includes, where legally permitted:
- loss of local gameplay progress;
- loss of device data;
- loss of profits;
- loss of opportunity;
- loss of goodwill;
- third-party service interruption; or
- advertisement unavailability.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by mandatory law.
21. Mandatory consumer rights
Some countries and regions provide mandatory consumer rights that cannot be excluded or limited by contract.
Nothing in these Terms removes rights that apply to you under mandatory consumer-protection law.
Where a disclaimer or limitation is not enforceable, it applies only to the maximum extent permitted by applicable law.
22. Termination
Your permission to use BurstLume may end if you materially violate these Terms.
You may stop using BurstLume at any time by uninstalling the App.
Termination does not require the deletion of an account because BurstLume does not create user accounts.
23. Governing law
These Terms are intended to be governed by the laws of Türkiye, without prejudice to mandatory consumer protections and rights that apply in the user’s country or region of residence.
This section does not remove any rights that cannot legally be waived.
This governing-law statement is provided as a starting point for owner review and does not constitute legal advice.
24. Changes to these Terms
We may update these Terms because of:
- feature changes;
- legal or regulatory requirements;
- security requirements;
- provider changes;
- advertising changes; or
- operational changes.
The effective date and last-updated date will be revised when these Terms change.
Continued use after an updated version becomes effective may constitute acceptance where permitted by applicable law.
25. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions remain in effect to the extent permitted by law.
